Journey to safer chemicals - REACH registration

01:45
For 10 years, chemical companies have assessed the risks of their chemicals used in Europe and sent that information to the European Chemicals Agency according to the criteria set out in the REACH Regulation. Today, we know more than ever before about the chemicals on the EU/EEA market, their properties and impacts. Companies are able to advise their customers on how to use them safely. ECHA together with the national authorities and the European Commission will use the knowledge to design EU wide measures to protect our citizens and the environment from any harmful effects. What are the REACH Regulations?

02:32
The REACH Regulations replace a number of directives with a single system EU regulation concerning the registration, evaluation, authorisation and restriction of chemicals. The Regulations are in place to provide a high level of protection to human health and the environment from the use of chemicals and to make the people who place chemicals on the market responsible for understanding and managing the risks associated with their use.

BOOK REVIEW EU CHEMICALS REGULATION New Governance, Hybridity and REACH By Steven Vaughan ISBN: 978 1 78471 130 6 (cased) 978 1 78471 131 3 (eBook) EDWARD ELGAR PUBLISHING LIMITED www.elgaronline.com www.e-elgar.com The book is available electronically in the Elgaronline Law subject collection DOI 10. 4337/9781784711313 AT LAST – A CLEAR AND SCHOLARLY EXAMINATION OF “REACH” IN EUROPEAN UNION ENVIRONMENTAL LAW An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers The author of this book, Steven Vaughan admits that ‘chemicals regulation is not one of the hot subjects in environmental law.’ It does not have quite the same cachet, he adds ‘as, say, climate change or environmental justice.’ However, as Vaughan points out in his succinct yet detailed introduction, chemicals and their regulation should obviously preoccupy us more than they do. There are more than 100,000 of them out there, chemicals we mean, some of which we eat, or breathe or absorb through our skin. They are a part of nature, yet some are hazardous. Over 40,000 of them may pose a minimal risk – hence the growing need for European Union chemicals legislation which aims to generate information about impacts and protection against potential harms. The EU has therefore adopted a number of legislative instruments aimed at the control of chemicals across a range of commercial sectors. The focus of this monograph, as the subtitle indicates, is on REACH – the EU Regulation on the Registration, Evaluation, Authorisation and Restriction of Chemicals, which came into force in 2007. Its regulator, ECHA is the European Chemicals Agency. REACH, says the author is a daunting piece of legislation ‘one of the longest legislative instruments in the history of the EU’ and ideally requires a familiarity with toxicology to fully understand it, which is why, as the author suggests, it has engendered little in the way of significant academic writing. This book therefore does much to fill that gap and deserves full marks for the clarity of its writing and explanation. Then there is the subject of hybridity which is explained in a number of ways, including the existence of public and private regulation. Primarily however, the book concerns itself with the yoking together of hard and soft norms as the result of a shift to ‘new governance’ which will be familiar to governance scholars at whom the book is partly aimed. There is little doubt that legal practitioners, (especially environmental lawyers), consultants, academics and policy makers will come to regard this book as an important and accessible explanation of REACH and also an useful starting point for further research on EU chemicals legislation. The publication date is cited as at 2015.

What Is the New REACH Guidance?

02:43
On June 28, 2017 the European Chemicals Agency released an update to their guidance on requirements for substances in articles. This guidance, for the REACH Regulation, clarifies communication requirements for substances of very high concern (SVHCs), in relation to the Court of Justice of the European Union's (CJEU) 'once an article always an article' ruling. The ruling was necessary in response to a number of EU Member States who did not agree with the interpretation. France was committed to enforcing REACH under their own interpretation of the 'once an article always an article' ruling. This resulted in two French trade associations requesting a ruling from the European Court of Justice. Prior to the updated guidance, companies have been adapting without official guidance from the European Chemicals Agency. The ruling states that SVHC compliance should be based on concentration thresholds for each individual article within a product or object, not the product as a whole. This was a game changer for industry. With this release, suppliers and importers now have the context they need to assess compliance with the requirements of Article 33 and Article 7(2) of the REACH Regulation. The improvements offer a more comprehensive set of examples to help them understand the conditions under which they must communicate the composition of their products. This is a strong signal that the ECHA will continue to provide further and ongoing industry guidance in relation to the REACH Regulation. WHAT YOU CAN EXPECT FROM THE LATEST CHANGE IN REACH

01:33
REACH is a regulation from the European Union that regulates chemical use in order to improve the health of humans and the environment. The change in interpretation redefines articles and their chemical substances forces supply chains to conduct more time-consuming analyses to look for Substances of Very High Concern and report them. Under the new interpretation, sub-components of a product must now be tested and reported for the presence of Substances of Very High Concern if the component’s presence is above 0.1% of the article weight. Candidate List of substances of very high concern change rapidly, making it challenging for companies without a data partner to keep up with REACH’s obligations. SiliconExpert keeps you on schedule by evaluating, defining and monitoring every data point of your product construction to keep up with REACH compliance.

REACh: Innovation and integrated EU goals

03:41
Technical innovation plays a significant role in the achievement of the integrated goals of the European Union such as Energy Roadmap 2050 or Resource- efficiency. One main objective of the European Chemicals Legislation’s REACh is to enhance innovation. This should be triggered by the introduction of the candidate list and authorisation route, stimulating the development of safer alternatives to various chemicals. The High Technology sector, dependent on a few innovative key materials, might be highly affected by such substitution-driven mechanisms. Are EU decision-makers fully aware of the direct impact of REACh regulation on key materials, on the one hand, and their relevance for achieving the requirements and objectives of other policy areas, on the other? What should be the appropriate consistent regulatory framework to create a climate that is open to innovation more broadly? The High Tech sector is concerned about the potentially significant negative impact of REACh on innovation and business development. Are these concerns justified? What is the European semiconductors industry’s interpretation of “true innovation“? What is the role of other drivers for innovation such as energy or materials efficiency?

[Webinar] REACH: The Guidance & Five New SVHCs

33:49
When the Court of Justice of the European Union issued its ruling last year that the presence of substances of very high concern in complex articles must be assessed at the parts level, it was clear some companies would have to change the way they manage their REACH compliance programs. However, the full impact of this ruling wasn’t known until the European Chemicals Agency (ECHA) released its new guidance in late 2015. Shortly afterwards, the ECHA also added five new SVHCs to the Candidate List. This webinar is a great opportunity for companies with products in scope of REACH to gain a better understanding of what this guidance will mean for their programs. About REACH

00:47
http://www.sureteam.co.uk/ R.E.A.C.H (Registration, Evaluation, Authorization, and Restrictions of Chemicals) is a European Union Regulation, and it's a serious mandate for every business in the U.K. It's for control of chemicals, says Peter Hodgson, Managing Director at Sureteam, every chemical sold or used should be on the registered list, as far as mandatory health and safety requirements go. R.E.A.C.H. helps provide information about dangerous chemicals. Information such as whether chemicals are dangerous or not? What's the boiling point? How about the flash point? Are there any warnings with respect to a particular chemical? R.E.A.C.H. is a mandate, a strong one at that.

REACH: A test case for better regulation?

03:08
With the adoption of the Better Regulation Agenda on 19th May, the European Commission is taking first concrete steps in the definition of its policy. This issue is expected to be heavily discussed in Parliament and Council in the following weeks, all the more since the Parliament has been very careful about the risk of better regulation being misused to remove environmental laws. There is a growing interest across stakeholders for the application of the better regulation approach to the management of chemicals. The Commission, the Parliament, the Council and the industry have started to look into a more consistent interaction between REACH and workplace legislation. Trade unions have been vocal about speeding up the process of implementing relevant workplace legislation, encouraging the Commission to adopt exposure limits for a number of chemicals. 􏰀 What are the most “burdensome” aspects of REACH authorization and how could they be tackled? 􏰀 How do exposure limits contribute to a safe management of chemicals? Where are there duplications with REACH? What could be simplified? 􏰀 How can workplace legislation and its effective implementation contribute to safe chemicals management? What synergies could be used between REACH and workplace legislation? 􏰀 How can better regulation elements be applied in chemicals management in the interest of health and safety, environmental protection and competitiveness?
