Composed in 1905, while Geronimo was being held as a U.S. prisoner of war at Fort Sill, Oklahoma, Geronimo’s story found audience and publication through the efforts of S. M. Barrett--Lawton, Oklahoma, Superintendent of Education, who wrote in his preface that “the initial idea of the compilation of this work was . . . to extend to Geronimo as a prisoner of war the courtesy due any captive, i.e. the right to state the causes which impelled him in his opposition to our civilization and laws.” Barrett, with the assistance of Asa Deklugie, son of Nedni chief Whoa as Apache translator, wrote down the story as Geronimo told it --beginning with an Apache creation myth. Geronimo recounted bloody battles with Mexican troopers, against whom he had vowed vengeance in 1858 after they murdered his mother, his wife, and his three small children. He told of treaties made between Apaches and the U.S. Army--and treaties broken. There were periods of confinement on the reservations, and escapes. And there were his final days on the run, when the U.S. Army put 5000 men in the field against his small band of 39 Apache. Geronimo had been a prisoner of war for 19 years when he told his story. Born in 1829, he was by then an old man, no longer a warrior, and he had come to an accommodation with many things “white,” including an appreciation of money. U.S. Bureau of Indian Affairs personnel took him to the St. Louis World’s Fair in 1904, where he roped cows in the “wild west show” and signed his name for “ten, fifteen, or twenty five cents.” By then he was perhaps the United States’ most “famous” Indian. In 1905 he was even invited to ride horseback in President Theodore Roosevelt’s inaugural parade (though still a prisoner of war!). Geronimo dedicated his book to Roosevelt with the plea that he and his people be allowed to return to their ancestral land in Arizona. “It is my land, my home, my father’s land, to which I now ask to be allowed to return. I want to spend my last days there, and be buried among those mountains. If this could be I might die in peace.” Geronimo died at Fort Sill, Oklahoma, in 1909, still a prisoner of war. The history of postal service of the United States began with the delivery of stampless letters, whose cost was borne by the receiving person, later also encompassed pre-paid letters carried by private mail carriers and provisional post offices, and culminated in a system of universal pre-payment that required all letters to bear nationally issued adhesive postage stamps. In the earliest days, Ship captains arriving in port with stampless mail would advertise in the local newspaper names of those having mail and for them to come collect and pay for it, if not already paid for by the sender. Postal delivery in the United States was a matter of haphazard local organization until after the Revolutionary War, when eventually a national postal system was established. Stampless letters, paid for by the receiver, and private postal systems, were gradually phased out after the introduction of adhesive postage stamps, first issued by the U.S. government post office July 1, 1847 in the denominations of five and ten cents, with the use of stamps made mandatory in 1855. Gunn v. Minton: Oral Argument - January 16, 2013

Facts: In the early 1990s, Vernon Minton, a former securities broker, developed the Texas Computer Exchange Network (TEXCEN) software that allowed financial traders to execute trades on their own. R.M. Stark & Co. (Stark) agreed to lease TEXCEN. More than one year later, Minton filed for a patent that was granted by the United States Patent and Trademark Office on January 11, 2000. Minton later sued the NASDAQ and the National Association of Securities Dealers (NASD) and alleged that their services infringed on his patent. NASD and NASDAQ argued that a patent is invalid when the invention claimed is sold more than a year before the patent application is filed. The district court granted summary judgment for NASD and NASDAQ. Minton retained new counsel to argue his case under the experimental use exception, which states that the patent remains valid if the invention was sold primarily for experimental, rather than commercial, use. He filed a motion for reconsideration, which the district court denied. The United States Court of Appeals for the Federal Circuit affirmed. Minton sued his original attorneys (collectively referred to as Gunn) for legal malpractice and argued that their failure to argue the experimental use exception in the original suit cost him the case. Gunn filed for summary judgment arguing no-evidence due to the fact that the attorneys did not know of the earlier sale in order for the experimental use exception to be relevant. The trial court granted summary judgment in favor of Gunn. Minton appealed to the Second Court of Appeals for Texas. Shortly after he filed his appeal, the United States Court of Appeals for the Federal Circuit decided a case that gave jurisdiction to the federal courts in malpractice suits arising from patent litigation. Minton filed a motion to dismiss his case from the Second Court of Appeals for Texas, but the court denied his motion and affirmed the decision of the trial court. The Supreme Court of Texas reversed and dismissed the case. Question: Do the federal courts have exclusive jurisdiction in any cases that involve patent law, even when the patent issue is not the primary issue in the case? Conclusion: No. Chief Justice John G. Roberts, Jr., writing for a unanimous Court, reversed the lower court and remanded. The Supreme Court applied Grable & Sons Metal Products, Inc. v. Darue Engineering & Mfg. , which provided that a case only arises under federal patent law when it "necessarily raise[s] a stated federal issue, actually disputed and substantial, which a federal forum may entertain without disturbing any congressionally approved balance of federal and state judicial responsibilities." The Court held that Minton failed to show that the federal issue in the case carried the necessary significance. The need to decide a hypothetical patent case is not substantial enough to deprive the state court of jurisdiction. A state court decision in a state law malpractice case relating to patent law will not substantially affect federal patent law. It discusses his time spent in slavery, serving primarily on galleys, documents his attempts at becoming an independent man through his study of the Bible, and his eventual success in gaining his own freedom and in business thereafter. The book contains an interesting discussion of slavery in West Africa and illustrates how the experience differs from the dehumanising slavery of the Americas.
