Recording of Unique Identity Number of Foreign Diplomatic Missions / UN Organizations on invoices while making supplies Complaints have been received from Foreign Diplomatic Missions / UN Organizations regarding unwillingness of vendors / suppliers / E-commerce websites to record the UIN (Unique Identify Number) while making sales to such Embassies / Missions / Consulates or UN organizations. 2. Unique Identification Number (UIN) is a 15-digit unique number allotted to any specialised agency of the United Nations Organisation or any Multilateral Financial Institution and Organisation notified under the United Nations (Privileges and Immunities) Act, 1947, Consulate or Embassy of foreign countries. First two digits of the UIN denotes State code where such entity is located. 3. It may be noted that supply to Foreign Diplomatic Missions / UN Organizations is like any other Business to Consumer (B2C) supply and will not have any additional impact on the supplier’s tax liability. Recording of UIN while making such supplies by the suppliers will enable Foreign Diplomatic Missions / UN Organizations to claim refund of the taxes paid by them in India. Therefore, it is advised that suppliers should record the UIN of the Embassies / Missions / Consulates or UN organizations on the tax invoice. 4. It has been noticed many big brands for groceries, clothing, super stores etc. have been denying this facility to Embassies and Consulates. Such organizations / stores are advised to amend their processes / software and enable recording of UIN when insisted upon by a diplomat or an official of a Foreign Diplomatic Missions / UN Organizations. 5. Attention is invited to Circular No. 43/17/2018-GST dated 13th April 2018 which provides that recording of UIN on the invoice is a necessary condition under rule 46 of the CGST Rules, 2017. If suppliers / vendors are not recording the UINs, action may be initiated against them under the provisions of the CGST Act, 2017. 6. Search functionality for UIN is available on the GST Common Portal in “Search Taxpayer” option. On entering UIN and captcha, details of the entity will be available.

Facts: The London Interbank Offer Rate (LIBOR) is a daily interest rate benchmark that is used to help set the interest rate of financial transactions across the globe. Between August 2007 and May 2010, it has been alleged that the LIBOR rate was artificially manipulated downward by a number of colluding financial institutions. Ellen Gelboim was one of many parties to file individual suits against these financial institutions. Given the large number of cases, Gelboim's case was consolidated with a number of other similar cases for pre-trial purposes. During this pre-trial phase, the district court dismissed a number of the cases, including Gelboim's, for failure to state a claim. Gelboim sought to appeal the dismissal, however the U.S. Court of Appeals for the Second Circuit dismissed Gelboim's appeal and held that it lacked jurisdiction over the appeal because the district court had not entered a final order concerning all the claims in the consolidated action. Question: Is a dismissed claim immediately appealable if the claim is part of a consolidated action and no final order has been issued concerning all claims in the action? Conclusion: Yes. Justice Ruth Bader Ginsburg delivered the opinion for the unanimous Court. The Court held that, because cases that are consolidated for pretrial proceedings retain their separate identities, the question is not whether all claims within the consolidated cases have been subject to a final order, but whether the specific case which is being appealed has been subject to a final order. Because Gelboim's case had been dismissed without leave to amend, the dismissal acted as a final order and thus Gelboim could appeal the district court's dismissal of her case. Facts: Under the Employee Retirement Income Security Act (ERISA), plan administrators must provide all plan participants with a "summary plan description" (SPD), as well as a "summary of material modifications" when material changes are made to the plan. After CIGNA converted its traditional defined benefit pension plan to a cash balance plan, it issued a summary plan description to plan participants. In 2001, Janice Amara, one of the participants, filed a class-action lawsuit, claiming that CIGNA failed to comply with ERISA's notice requirements and SPD provisions. The U.S. District Court for the District Connecticut found for Amara, and the U.S. Court of Appeals for the Second Circuit affirmed, finding that the SPD misrepresented the terms of the plan itself. Question: Did the district court have authority under Section 502(a)(1)(B) of ERISA to reform CIGNA's pension plan? Conclusion: No. The Supreme Court vacated and remanded the lower court order, finding that while the district court did not have authority under Section 502(a)(1)(B) of ERISA to reform CIGNA's pension plan, it did have authority to do so under another provision, Section 502(a)(3). In a unanimous decision authored by Justice Stephen Breyer, the Court noted that "although §502(a)(1)(B) did not give the District Court authority to reform CIGNA's plan, relief is authorized by §502(a)(3), which allows a participant, beneficiary, or fiduciary 'to obtain other appropriate equitable relief' to redress violations of ERISA 'or the [plan's] terms.'" Justices Antonin Scalia and Clarence Thomas concurred only in the judgment. Meanwhile, Justice Sonia Sotomayor did not take part in consideration of the case.
